Most people who fall behind on several years of tax returns assume the penalties are locked in for good. They file, they pay, and they move on. But when you have multiple unfiled or unprocessed years, the order in which those returns hit the IRS system can decide whether you get thousands of dollars back.
At WATAX, we recently recovered a five-figure penalty payment for a client by filing returns the IRS wasn't even asking for. Here's how First-Time Abatement works for multi-year non-filers, and why the details matter so much.
How First-Time Abatement works
First-Time Abatement (FTA) is an IRS administrative waiver. It can remove failure-to-file, failure-to-pay and failure-to-deposit penalties, plus the interest charged on those penalties. It does not remove the underlying tax or the interest on that tax.
To qualify, a taxpayer generally needs:
- No significant penalties in the three tax years before the penalty year
- All currently required returns filed
- The tax paid, or a payment arrangement in place
Here is the part most taxpayers miss. FTA covers only one tax period. When penalties exist in several years, the IRS applies FTA to the earliest year that qualifies, not the year you'd choose. For multi-year non-filers, that means the strategy is really about which year becomes your "first" penalty year, and whether the three years before it are clean on the IRS's records.
A real case: $20,000 in penalties and interest recovered
A client came to us having filed their 2021 through 2024 returns. Their 2019 and 2020 returns had been prepared, but the IRS had never processed them. Here's where each year stood:
Tax year -Status when we took the case - Balance due
2019 - Not processed by IRS - None
2020 -Not processed by IRS -None
2021 -Filed -None
2022- Filed -About $20,000 in penalties and interest, already paid by the client
2023–2024 - Filed
On paper, 2022 looked like a dead end. The client had already paid, and with 2019 and 2020 missing from IRS records, the three-year lookback before 2022 wasn't clean.
So we filed 2019 and 2020, even though they fell outside the IRS's usual six-year filing window. Once those returns processed, the record showed three prior years filed with no penalties. That opened the door to First-Time Abatement on 2022, and the client got their penalty payment back.
Why this strategy worked
We looked past the six-year window. The IRS generally asks delinquent filers for their last six years of returns. Most preparers stop there. But FTA eligibility depends on the three years before the penalty year, and those years can sit outside the window. Filing them, even when no one is demanding them, can be what makes a later year qualify.- We controlled the order. Because FTA lands on the earliest qualifying penalty year, we mapped every year first. Here, 2019 through 2021 carried no balance and no penalties, which made 2022 the first penalty year with a clean history behind it.
- We faxed the older returns. Paper returns mailed to the IRS can sit unprocessed for months, or never post at all, as this client learned. For older-year returns, faxing has been our most reliable way to get them onto the record.
- We moved inside the refund window. A penalty refund claim generally must be made within two years of payment. The client paid the 2022 balance within the last two years, so the money was still recoverable. Wait too long and the abatement can't put cash back in your pocket.
One note: abatement removes the penalties and the interest charged on them. Interest on the underlying tax stays.
How WATAX handles multi-year non-filer cases
Every multi-year non-filer case we take on includes a penalty abatement review. Before a single return goes in, we map the client's full filing and penalty history and decide which years to file, in what order, and how to send them.
The IRS has started applying First-Time Abatement automatically for newer tax years. That helps people with a single late return. It doesn't untangle six or eight years of missing, unprocessed or out-of-order filings. Those cases turn on judgment calls about timing, lookback years and refund deadlines.
That's why we believe multi-year filing is still work for experienced people, not software or AI. The difference in this case was about $20,000.
